We may also use your name if you have previously not paid\nthe assessment on time.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>For\nthose owners who rent out their property, we will correspond with either the\nagent responsible or the owner directly, if they have provided an address or\nemail to us to be able to do so.<\/li><\/ul>\n\n\n\n<h1 class=\"wp-block-heading\">How we get the personal information and why\nwe have it<\/h1>\n\n\n\n<p>Most of the personal information we\nprocess is provided to us directly by you for one of the following reasons:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Confirming\nyour payment of the assessment.<\/li><li>You\nhave contacted us regarding non-payment of the\nassessment.<\/li><li>You\nhave contacted us regarding the maintenance and upkeep of the estate.<\/li><\/ul>\n\n\n\n<p>We also receive personal information\nindirectly, from the following sources in the following scenarios:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>On\ncompletion of the sale of a property, information may be passed on to us by the\nsolicitor acting on your behalf, or on behalf of the seller.<\/li><li>On\nbank statements which will identify your payment, your name may also be\ngiven.&nbsp; We do not ask for this information.<\/li><li>If\nyou have failed to pay the assessment on time and we need to take court action,\nwe will check the Electoral Roll to find out your name. As stated in our\nConstitution, the name given on the Electoral Roll may be held responsible for\npayment of the assessment.<\/li><\/ul>\n\n\n\n<h1 class=\"wp-block-heading\">We use the information that you have given us\nin order to:&nbsp;<\/h1>\n\n\n\n<ul class=\"wp-block-list\"><li>confirm\nthat you have paid the annual assessment due<\/li><li>communicate\nwith you regarding payment of the assessment<\/li><li>communicate\nwith you regarding the maintenance of the estate.<\/li><\/ul>\n\n\n\n<p>We\nmay pass personal information on to a third party:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>if\nyou have failed to pay the assessment on time and legal\/court action is to follow<\/li><li>if\nthe matter concerned is not part of the Association\u2019s remit we may share this\ninformation with an elected representative or the Fairmilehead Community\nCouncil for action.<\/li><\/ul>\n\n\n\n<p>Under the General Data Protection\nRegulation (GDPR), the lawful basis we rely on for processing this information\nis that we have a legitimate interest.<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Purpose:\nTo encourage all members to pay the assessment, as required by the title deeds\nand for the purpose that all members pay fairly for the upkeep of the estate.\nWe will publish the address of those members who do not pay the assessment on time.<\/li><li>Necessity:\nThe Buckstone Association believes this publication is necessary so as to take\naction against non-payers. The alternative of bringing debt recovery\nproceedings is likely to cost more than the amount recovered and is used only\nagainst persistent non- payers.<\/li><li>Balance:\nThe potential impact of this publication has been considered and&nbsp; the Buckstone Association believes&nbsp; that&nbsp;\nthe&nbsp; rights&nbsp; and interests&nbsp;\nof&nbsp; the&nbsp; individuals&nbsp;\ndo&nbsp; not outweigh this purpose and\nas this potential action is notified to all members, the Buckstone Association\nbelieves&nbsp; that&nbsp; this&nbsp;\naction is&nbsp; what&nbsp; the&nbsp;\nnon-paying&nbsp; member might expect.<\/li><\/ol>\n\n\n\n<h1 class=\"wp-block-heading\">How we store your personal information<\/h1>\n\n\n\n<p>Your information is securely stored\nwith our Administrator.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Email\ncorrespondence will be kept for 6 years or until such time as you are no longer\na member of the Association, if we are made aware of that fact. Such\ncorrespondence will then be deleted.<\/li><li>Paper\ncorrespondence will be kept for 6 years or until such time as you are no longer\na member of the Association, if we are made aware of that fact.&nbsp; Such correspondence will then be disposed of\nin a secure manner.<\/li><li>Any\nlegal documentation relating to any member will be kept until such time as you\nare no longer a member of the Association. Such correspondence will then be\ndisposed of in a secure manner.<\/li><li>For\nthose members who do not pay on time, their records may be kept indefinitely.<\/li><li>Bank\nstatements may be kept indefinitely.<\/li><li>Minutes\nof committee meetings, Annual Reports and minutes of Annual General Meetings or\nany other general meetings will be kept indefinitely.<\/li><\/ul>\n\n\n\n<h1 class=\"wp-block-heading\">Your data protection rights<\/h1>\n\n\n\n<p>Under data protection law, you have\nrights including:<\/p>\n\n\n\n<p>Your right of access &#8211; You have the\nright to ask us for copies of your personal information.<\/p>\n\n\n\n<p>Your right to rectification &#8211; You have\nthe right to ask us to rectify personal information you think is inaccurate.\nYou also have the right to ask us to complete information you think is\nincomplete.<\/p>\n\n\n\n<p>Your right to erasure &#8211; You have the\nright to ask us to erase your personal information in certain circumstances.<\/p>\n\n\n\n<p>Your right to restriction of\nprocessing &#8211; You have the right to ask us to restrict the processing of your\npersonal information in certain circumstances.<\/p>\n\n\n\n<p>Your right to object to processing &#8211;\nYou have the the right to object to the processing of your personal information\nin certain circumstances.<\/p>\n\n\n\n<p>Your right to data portability &#8211; You\nhave the right to ask that we transfer the personal information you gave us to\nanother organisation, or to you, in certain circumstances.<\/p>\n\n\n\n<p>You are not required to pay any charge\nfor exercising your rights.
